LovingEcards is an online platform that allows people, families, teams, communities, and organizations to create, personalize, sign, share, schedule, and deliver digital greeting cards and invitations.

Depending on the features available, users may be able to:

• Create individual or collaborative group cards
• Invite other people to contribute to a card
• Add written messages, names, emojis, photographs, images, or animated GIFs
• Customize the appearance of a card or message
• Share a card through a direct link or email
• Schedule a card for later delivery
• Create and share digital invitations
• Use free or paid card features
• Read articles, wishes, quotes, and celebration ideas on the LovingEcards blog

Certain features may vary according to the card type, selected plan, location, device, or availability of third-party services.

2. Definitions

For the purposes of these Terms:

• “Account” means a registered LovingEcards user account.
• “Card Creator” means the person who creates, organizes, manages, or purchases a digital card through the Service.
• “Company,” “LovingEcards,” “we,” “us,” or “our” means LovingEcards.
• “Contributor” or “Signer” means a person invited to add a message, name, image, or other content to a card.
• “Device” means a computer, smartphone, tablet, or other device capable of accessing the Service.
• “Invitation Creator” means a person who creates or manages a digital invitation through LovingEcards.
• “Recipient” means the person or group for whom a card or invitation is created or delivered.
• “Service” means the LovingEcards website, card and invitation platform, blog, tools, designs, features, communications, and related services available through https://lovingecards.com.
• “Terms” means these Terms and Conditions.
• “User Content” means any message, text, name, photograph, image, GIF, video, design choice, comment, invitation detail, or other material submitted, uploaded, added, or shared by a user through the Service.
• “User” or “you” means any person or organization that accesses or uses the Service, including Card Creators, Contributors, Invitation Creators, and Recipients.
• “Website” means LovingEcards, accessible at https://lovingecards.com.

3. Acceptance of These Terms

By using LovingEcards, you confirm that:

• You have read and understood these Terms
• You agree to follow these Terms
• You have the legal authority to accept these Terms
• Any information you provide is accurate and lawful
• You will use the Service only for legitimate personal or professional purposes

When you use LovingEcards on behalf of a business, school, university, nonprofit, healthcare organization, employer, or another legal entity, you confirm that you are authorized to accept these Terms on its behalf.

Your use of the Service is also subject to our Privacy Policy, Cookie Policy, and any additional rules or notices displayed in connection with a particular feature.

4. Eligibility and Use by Minors

You must be at least 18 years old, or the legal age of majority in your location, to independently create an Account, purchase paid services, or enter into a binding agreement with LovingEcards.

Parents, guardians, educators, and organizational administrators are responsible for supervising the use of LovingEcards by minors under their authority.

We do not knowingly permit children to create independent paid accounts or make purchases without appropriate authorization.

5. User Accounts

Some LovingEcards features may require an Account.

When creating an Account, you agree to provide accurate and current information. You are responsible for keeping your login credentials confidential and for all activity that occurs through your Account.

You must not:

• Share your password with an unauthorized person
• Use another person’s Account without permission
• Create an Account using false or misleading information
• Attempt to gain unauthorized access to another Account
• Sell, transfer, or misuse an Account

Please contact us promptly if you believe your Account has been accessed without authorization.

We are not responsible for losses caused by your failure to protect your login details, except where applicable law provides otherwise.

6. Creating and Managing Group Cards

Card Creators are responsible for the cards they create and manage through LovingEcards.

As a Card Creator, you are responsible for:

• Selecting an appropriate card and design
• Entering accurate recipient and delivery information
• Sharing the signing link only with appropriate contributors
• Reviewing card content before delivery where review tools are available
• Choosing suitable privacy, contribution, and delivery settings
• Ensuring that the card is used for a lawful and appropriate purpose
• Removing or reporting inappropriate contributions when management tools are available
• Confirming the intended delivery date, time, and recipient

LovingEcards may provide tools that allow Card Creators to invite Contributors, edit card details, manage submissions, or schedule delivery. Available controls may differ depending on the card type or plan.

The Card Creator remains responsible for how the card link is distributed and who receives access to it.

7. Signing and Contributing to Cards

Contributors may be invited to add messages or media to a group card.

By contributing to a card, you agree that:

• Your contribution may be visible to the Card Creator, other Contributors, and the Recipient
• Your name or chosen display name may appear with your contribution
• The Card Creator may have the ability to review, edit, hide, or remove contributions
• Your message may become part of a completed digital card delivered to the Recipient
• You will not submit unlawful, harmful, offensive, misleading, or infringing content
• You have permission to upload any photographs, images, GIFs, or other media you provide

Contributors should avoid including confidential, highly sensitive, financial, medical, or private personal information in a card.
A group card is designed to be shared. You should only contribute information that you are comfortable sharing with the intended participants and Recipient.

8. Digital Invitations

LovingEcards may allow users to create and share digital invitations for birthdays, weddings, anniversaries, baby showers, dinner parties, workplace events, and other occasions.
Invitation Creators are solely responsible for:

• Providing accurate event details
• Confirming the event date, time, location, and contact information
• Ensuring that the event is lawful and safe
• Managing guest communications
• Informing guests about cancellations or changes
• Obtaining any required venue permissions, licences, insurance, or approvals
• Protecting private event information and guest details

LovingEcards provides invitation creation and sharing tools but does not organize, supervise, sponsor, or guarantee events created by users.

We are not responsible for event cancellations, inaccurate details, venue problems, travel arrangements, guest conduct, injuries, property damage, or disputes between event organizers and guests.

9. Shareable Links and Privacy

Cards and invitations may be shared through direct links, email, or other available methods. Depending on the selected settings, a person with access to a link may be able to view, sign, or share the card or invitation. Users should treat card and invitation links carefully.

You agree not to:

• Post a private card link publicly without permission
• Share a signing link with unrelated or unauthorized people
• Attempt to access a card not intended for you
• Collect personal information from Contributors or Recipients without permission
• Use a card or invitation link for harassment, spam, fraud, or impersonation

LovingEcards cannot control how a link is shared after it has been copied or sent by a user.

Card Creators and Invitation Creators are responsible for using available privacy settings appropriately and for distributing links only to intended participants.

10. User Content

You retain ownership of the original User Content you submit to LovingEcards.

By uploading, entering, or submitting User Content through the Service, you grant LovingEcards a non-exclusive, worldwide, royalty-free, limited licence to host, store, reproduce, process, format, transmit, display, and deliver that content only as reasonably necessary to:

• Operate the Service
• Display the content within a card or invitation
• Make the content available to intended Contributors or Recipients
• Process or deliver the card or invitation
• Maintain security and prevent misuse
• Provide customer support
• Comply with legal obligations
• Improve the technical operation of the Service

This licence does not transfer ownership of your User Content to LovingEcards.

You confirm that:

• You own the User Content or have permission to use it
• Your content does not violate another person’s rights
• Your content does not breach any confidentiality obligation
• Your content is lawful and appropriate
• You have obtained consent from identifiable people shown in uploaded media where required
• Your content does not contain malware, harmful code, or deceptive links

You are responsible for the User Content you submit and for any consequences resulting from its use or delivery.

11. Prohibited Content and Conduct

LovingEcards is intended for positive communication, celebration, appreciation, invitations, and meaningful connection.

You must not use the Service to create, upload, send, publish, or distribute content that:

• Threatens, harasses, bullies, humiliates, or intimidates another person
• Promotes hatred, violence, discrimination, or abuse
• Is defamatory, knowingly false, or malicious
• Is sexually explicit, exploitative, or inappropriate
• Exploits or endangers children
• Encourages self-harm, violence, terrorism, or criminal activity
• Violates intellectual property, privacy, publicity, or confidentiality rights
• Contains another person’s private information without permission
• Impersonates another person, organization, or brand
• Promotes fraud, phishing, scams, or deceptive activity
• Contains viruses, malicious code, or harmful software
• Is sent as unsolicited advertising or bulk spam
• Violates applicable laws or regulations
• Interferes with the operation or security of LovingEcards

You must not attempt to scrape, copy, reverse engineer, overload, disrupt, bypass, or gain unauthorized access to any part of the Service.

You must also not use automated systems, bots, or scripts to create accounts, submit card contributions, collect information, or misuse platform features without our written permission.

12. Content Review and Removal

LovingEcards is not obligated to monitor every card, invitation, message, or uploaded file.

However, we may review, restrict, hide, remove, or disable access to User Content when we reasonably believe that it:

• Violates these Terms
• Is unlawful or harmful
• Infringes another person’s rights
• Threatens the security or operation of the Service
• Exposes LovingEcards or its users to legal or safety risks
• Has been reported by a user, rights holder, or authority

We may take action without prior notice when immediate action is reasonably necessary.

Our decision not to remove particular content does not mean that we approve, endorse, or accept responsibility for it.

13. Intellectual Property Rights

The LovingEcards platform and its original materials are owned by or licensed to LovingEcards.

You are responsible for providing accurate email addresses and delivery details.

We make reasonable efforts to process communications and scheduled deliveries, but we cannot guarantee that every email, notification, card, or invitation will:

• Reach the intended recipient
• Arrive at an exact minute
• Avoid spam or promotional folders
• Be accepted by the recipient’s email provider
• Remain accessible indefinitely
• Display identically on every device or email service

Delivery may be affected by incorrect contact information, spam filters, email provider rules, internet outages, technical errors, device compatibility, or third-party service interruptions.
Users should verify important deliveries independently when necessary.

16. Free and Paid Features

LovingEcards may provide both free and paid features.

Paid features may include premium card designs, expanded customization, additional contributors, business features, delivery options, or other services described on the Website.

Prices, features, and limitations will be displayed before purchase where applicable.

By purchasing a paid feature, you agree to:

• Provide accurate billing information
• Pay the amount displayed at checkout
• Authorize our payment processor to charge your selected payment method
• Pay any applicable taxes or transaction charges
• Review the details of your purchase before completing payment

Payments may be processed by third-party payment providers. LovingEcards may not directly receive or store your complete payment card details.

17. Subscriptions and Renewals

Where LovingEcards offers subscription plans, the billing frequency, price, included features, renewal terms, and cancellation method will be shown before purchase.

Unless otherwise stated at checkout, subscriptions may automatically renew at the end of each billing period until cancelled.

You are responsible for cancelling a subscription before the next renewal date if you do not wish to continue it.

Changes to subscription pricing will be communicated as required by applicable law and will apply from the stated future billing date.

18. Cancellations and Refunds

• Refunds may not be available after a card has been delivered
• Refunds may not be available for incorrect recipient information provided by the user
• Refunds may not be available when a scheduled delivery fails because of an external email provider or incorrect contact details
• Duplicate or unauthorized charges should be reported promptly

Approved refunds will generally be returned through the original payment method and may take additional time to appear depending on the payment provider.

Any separate Refund Policy published on LovingEcards will form part of these Terms.

19. Business and Organizational Use

Businesses, employers, universities, healthcare organizations, nonprofits, and other groups may use LovingEcards for internal celebrations, employee appreciation, farewells, recognition, invitations, and related purposes.

Organizations are responsible for:

• Ensuring that their use complies with employment, privacy, and data protection laws
• Obtaining any required employee, student, patient, volunteer, or member permissions
• Controlling who can create, access, or contribute to cards
• Avoiding the submission of confidential workplace or personal information
• Ensuring authorized use of organizational email addresses and branding
• Managing their own internal policies and approvals

LovingEcards is not responsible for disputes between an organization and its employees, contractors, students, members, guests, or other users.

20. Blog and Informational Content

The LovingEcards blog may provide message examples, wishes, quotes, poems, celebration ideas, workplace activities, relationship content, and other informational resources.

This content is provided for general inspiration and informational purposes.

Users should adapt messages according to the recipient, relationship, culture, workplace, and circumstances. LovingEcards does not guarantee that every suggested message will be appropriate for every person or situation.

Blog content does not constitute legal, medical, financial, employment, mental health, or professional advice.

21. Feedback and Suggestions

You may choose to provide feedback, ideas, comments, or suggestions about LovingEcards.

By submitting feedback, you allow us to use it to evaluate, improve, promote, or develop the Service without payment or obligation to you.

This does not give us ownership of unrelated confidential information or User Content submitted inside a card.

22. Service Availability and Changes

We aim to keep LovingEcards accessible and reliable, but we do not guarantee continuous or uninterrupted availability.

We may modify, update, suspend, restrict, or discontinue any part of the Service for reasons including:

• Maintenance
• Security
• Technical improvements
• Legal or regulatory requirements
• Third-party service changes
• Feature development
• Business or operational decisions

We may introduce, remove, or change card designs, invitation templates, features, free limits, paid options, storage periods, and supported devices.

Where reasonably possible, we will provide notice of significant changes that materially affect active paid users.

23. Card Storage and Availability

Digital cards and invitations may not remain stored or accessible forever.

Storage periods may depend on the card type, Account status, selected plan, technical requirements, legal obligations, or platform policies.

Users should save any information or content they wish to preserve separately.

We are not responsible for the permanent storage of cards, invitations, messages, or uploaded media unless we have expressly agreed otherwise in writing.

24. Suspension and Termination

We may suspend, restrict, or terminate your access to LovingEcards if:

• You violate these Terms
• You misuse the Service
• Your conduct creates legal, safety, or security risks
• You fail to make a required payment
• You engage in fraud, spam, harassment, or infringement
• We are required to act by law or a competent authority
• Continuing to provide the Service is no longer reasonably possible

Where appropriate, we may provide notice or an opportunity to correct the issue. Serious violations may result in immediate action.

You may stop using the Service at any time. Where account deletion tools are available, you may request deletion subject to our legal, security, payment, and data retention obligations.

Termination does not remove rights or obligations that arose before termination.

• Cards and invitations will be delivered at an exact time

• User Content will be suitable, accurate, or appropriate
• Technical issues will always be corrected immediately
• The Service will meet every user’s particular needs

To the fullest extent permitted by law, we disclaim all express and implied warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and security.

Nothing in these Terms excludes any warranty or consumer right that cannot legally be excluded.

27. Limitation of Liability

To the maximum extent permitted by applicable law, LovingEcards and its service providers, licensors, employees, and Affiliates will not be liable for indirect, incidental, special, punitive, or consequential losses arising from or connected with the Service.

This includes loss arising from:

• Missed or delayed card delivery
• Incorrect recipient information
• Lost or deleted User Content
• Unauthorized sharing of card links
• User-submitted messages or media
• Third-party websites or integrations
• Email filtering or delivery failures
• Service interruptions
• Loss of profits, data, goodwill, opportunity, or business
• Event cancellation or incorrect invitation information

Where LovingEcards is found legally liable, our total liability relating to the Service will be limited to the greater of:

1. The amount you paid to LovingEcards for the specific Service giving rise to the claim during the six months before the event; or
2. USD $100.

Some jurisdictions do not permit certain exclusions or liability limits. In those jurisdictions, these limitations apply only to the greatest extent permitted by law.

Nothing in these Terms limits liability where doing so would be unlawful.

28. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless LovingEcards and its employees, service providers, licensors, and Affiliates from claims, losses, liabilities, damages, and reasonable legal expenses arising from:

• Your User Content
• Your misuse of the Service
• Your violation of these Terms
• Your infringement of another person’s rights
• A card, invitation, event, or communication created or managed by you
• Your unauthorized sharing of personal, confidential, or copyrighted material

This section does not require you to indemnify LovingEcards for conduct for which indemnification cannot legally be required.

29. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles.

Your use of LovingEcards may also be subject to mandatory local, state, national, or international laws that apply to you.

30. Informal Dispute Resolution

Before beginning formal legal proceedings, you agree to contact LovingEcards and make a good-faith effort to resolve the matter informally.

Please explain the nature of the concern, the relevant Account or transaction details, and the resolution you are seeking.

Nothing in this section prevents either party from seeking urgent legal relief when necessary to protect safety, security, confidential information, or intellectual property.

31. European Union and Other Consumer Rights

Users in the European Union, European Economic Area, United Kingdom, or other jurisdictions with mandatory consumer protections retain any rights that cannot be waived under local law.

Nothing in these Terms is intended to remove or restrict mandatory consumer, privacy, cancellation, or legal rights.

32. United States Legal Compliance

You represent that:

• You are not located in a country subject to a comprehensive United States government embargo where use of the Service would be prohibited
• You are not listed on a United States government list of prohibited or restricted parties
• You will not use LovingEcards in violation of applicable export control or sanctions laws

33. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be interpreted or modified to the minimum extent necessary.

The remaining provisions will continue in full force and effect.

34. Waiver

A delay or failure by LovingEcards to enforce a provision of these Terms does not waive our right to enforce it later.

A waiver relating to one violation does not constitute a waiver of any future violation.

35. Entire Agreement

These Terms, together with the Privacy Policy, Cookie Policy, Refund Policy where applicable, and any additional terms displayed for a particular feature, form the entire agreement between you and LovingEcards regarding the Service.

They replace any earlier discussions or agreements relating to the same subject matter.

36. Translation

These Terms may be made available in languages other than English.

Where permitted by law, the English version will control in the event of a conflict or difference in interpretation.

Mandatory local-language consumer rights will remain unaffected.
